1.2 Personal Data which LOVECELL collects includes but is not limited to the following:-

1.2.1 Your name, gender, identity card number, passport number, email address, phone number(s), home address, date-of-birth, race, ethnic origin, nationality and such personal information provided to LOVECELL;

1.2.2 Your marital status, details of spouse or children or immediate family, education, occupation, income range, employer name and contact details and such other relevant information from time to time requested by LOVECELL to enable us to provide you with our services or events like contest, forums, survey etc;

1.2.3 Personal Data collected when you submit your resume or application to us for consideration of employment (where applicable);

1.2.4 The content of electronic forms you submit via email requesting us to provide services or information, or to take any actions; and;

1.2.5 Any messages or comments you submit via our website, which may include personal data such as, but not limited to, name, email address and telephone number;

1.3 Where you have provided Personal Data of another individual (“Third Party”), you must ensure that you have informed the Third Party that you are providing the Third Party’s Personal Data to us, and have obtained the Third Party’s consent to do so.

1.4 Sources of personal information

1.4.1 Customer or potential customer: LOVECELL collects your personal information directly from you or indirectly via completed enquiry, application and/or registration forms via various means, including online and physical hardcopies at public venues or in any of our premises. Your personal information may also be collected from cookies through the use of our website or at any of our marketing events.

1.4.2 Vendor, supplier, tenant or service provider: LOVECELL collects your personal information directly from you or indirectly when you send us completed enquiry and / or credit application forms via various means, including online and physical hardcopies. Your personal information may also be collected from cookies through the use of our website or at any of our marketing events.

2.Consent And Purpose Of Collection

2.1 By providing any of your Personal Data to LOVECELL whether online or otherwise, you acknowledge that you have read, understood and agree to our personal data protection notice and you consent to the collection, retention and use of your Personal Data by us for any purposes but not limited of the following:-

2.1.1 fulfilling your instructions and providing you with services under any of LOVECELL’s business;

2.1.2 marketing of product(s) or service(s) and sending any advertising and/or promotional material to you via telephone calls, emails or sms services if you have checked the consent box in the Client’s Profile Form, Business Account Application Form and Application for Employment Form and Employee Personal Status Update Form;

2.1.3 conducting customer service feedback for LOVECELL;

2.1.4 notifying you of special offers, promotions, current and future product launches, special invitations that we consider might be of interest to you and for similar updates and promotion reasons via our Newsletter, Electronic Direct Mailers, Direct Mailers, etc;

2.1.5 monitoring your skin and/or health condition;

2.1.6 performing statistical and analysis of your behavior and characteristics for customer relationship management purposes, such as providing a suitable range of products for your beauty care needs;

2.1.7 purposes connected with the operation, administration, development or enhancement of LOVECELL’s business;

2.1.8 where required by law, where we consider that such use or disclosure is necessary to respond to any claims or legal process, or where LOVECELL suspects that fraud or unlawful activity has been, is being or may be engaged in;

2.1.9 making such disclosures as may be required for any of the above purposes or by law;

2.1.10 where you have provided your resume, considering you for any jobs that may arise in LOVECELL, and if applicable your terms and conditions of employment.

2.2 Please note that all information requested for in the relevant forms is obligatory to be provided by you unless stated otherwise.

Should you fail to provide the obligatory information or in the event that insufficient Personal Data is supplied, or is not satisfactory to LOVECELL, we would be unable to process your request and/or provide you with relevant services.

3.Disclosure of Personal Data

3.1 You further consent that Personal Data may be disclosed and transferred within LOVECELL Group which may include transfer to other entities within the LOVECELL Group of companies in different jurisdictions.

3.2 LOVECELL may disclose your personal information to:-

• Our directors and officers for purposes relating to your use of our services / products;
• Our auditors, lawyers, consultants and other advisors;
• Any party to whom LOVECELL Group’s rights are legally assigned/novated and / or transferred;
• Third party service providers, agents or contractors that the LOVECELL Group engages for the Purposes set out in Section 2;
• Any other party to whom such disclosure is required by law or regulatory requirement; and
• Any other persons under a duty of confidentiality to the Group or any company within the Group.

Notwithstanding that any such persons may be outside Malaysia, for any of the above Purposes or any other purpose for which your personal information was to be disclosed at the time of its collection or any other purpose directly related to any of the above Purposes.

4. SECURITY

4.1 We have put in place appropriate physical, electronic, and administrative procedures to safeguard the confidentiality and security of your personal information; and help prevent unauthorized access, disclosure, loss, misuse and to maintain data integrity;

4.2 LOVECELL will ensure the access to your personal information is restricted to relevant staff on a need-to-know basis;

4.3 LOVECELL will take reasonable steps to ensure that the personal information is accurate, complete, not misleading and kept up-to-date by having regard to the Purposes herein, including any directly related purposes, for which the personal information is collected and processed;

4.4 Where we appoint third party service providers, agents or contractors to provide services to us, we ensure that these third parties observe similar security measures as adopted by us.

5.STORAGE AND RETENTION OF THE PERSONAL DATA

5.1 Your Personal Data will be stored either in hard copies in LOVECELL’s offices or stored in servers located in Malaysia and operated by LOVECELL or any of its service providers.

5.2 The personal data collected will be retained by us for the duration required / permitted under Malaysian law. As a general rule the maximum retention period of the Personal Data of LOVECELL’s customers is eight (8) years. LOVECELL retains the Personal Data of its employees for as long as that individual remains as an employee of LOVECELL. LOVECELL shall take all reasonable steps to ensure that all personal information is destroyed or permanently deleted if it is no longer required for the Purposes stated herein.

• check whether LOVECELL holds data about you and of access to such data;
• request LOVECELL to correct any data relating to you which is inaccurate, incomplete, misleading or not updated;
• request clarification on LOVECELL’s policies and practices in relation to any personal data held by LOVECELL, except where compliance with a request to such access or correction is refused under the Act.
